Terms of Use

1. Agreement

By creating an account, accessing the service, or authorizing an integration, the user agrees to these terms and the Privacy Policy. A person acting for an organization confirms that they have authority to bind that organization.

2. The service

Creative Creatures provides agency diagnostics, scorecards, goals, leadership workspaces, performance monitoring, and integration tools. Features may change as the product develops.

3. Accounts and agency workspaces

Users must provide accurate account information, protect login credentials, and promptly report unauthorized access. Each user may access only workspaces and connected accounts they are authorized to use.

4. Third-party integrations

Integrations are optional. When a user connects Zoom or another provider, the user authorizes Creative Creatures to perform the actions disclosed in the integration interface and permission screen. For Zoom, this includes reading the connected user's profile and meetings and creating, updating, or deleting meetings when the user requests those actions.

Third-party services are governed by their own terms and availability. Creative Creatures is not responsible for a provider's outage, API change, account restriction, or deletion of third-party data.

5. Acceptable use

• Do not access another agency's workspace or connected account without authorization.
• Do not use the service to violate law, privacy, intellectual-property, or contractual rights.
• Do not probe, disrupt, bypass, scrape, reverse engineer, or overload security controls or infrastructure.
• Do not submit malware, stolen credentials, deceptive data, or unlawful content.

6. User content and permissions

Users retain rights in data they submit. Users grant Creative Creatures the limited permission needed to host, process, display, and transmit that data to operate the service. Users are responsible for having the rights and notices required for data they provide.

7. Availability and changes

The service is provided on an as-available basis. We may maintain, modify, suspend, or discontinue features. Planned functionality, projections, and automated insights are not guarantees.

8. Disclaimers

To the maximum extent permitted by law, the service is provided without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Dashboards and scorecards are business-support tools and are not legal, tax, accounting, investment, or employment advice.

9. Limitation of liability

To the maximum extent permitted by law, Creative Creatures is not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages, or for losses caused by third-party services. Any direct liability is limited to amounts paid for the service during the twelve months before the event giving rise to the claim.

10. Suspension and termination

Users may stop using the service and disconnect integrations at any time. We may suspend or terminate access for breach, security risk, unlawful conduct, non-payment, or material harm to users or the service. Terms that by nature should survive termination remain in effect.

11. Changes to these terms

We may update these terms when the service or legal requirements change. Material changes will be communicated through reasonable channels. Continued use after the effective date means the updated terms apply.
